This notice describes Daikin Comfort Technologies North America, Inc.’s and its subsidiaries’ (collectively “Daikin”) information collection and use practices on the platforms where this notice appears. This includes websites, mobile applications, equipment, and services. This notice may apply to other places where it does not appear. It does not apply to information about our employees.

Information We Collect

The type of personal information we collect depends on your relationship and interactions with us. In addition, certain state laws require us to tell their residents if we share information for cross-contextual behavioral advertising. Described below, by category, is the information we may collect and if we share it for cross-contextual behavioral advertising. Contact information.
 We may collect your name and address. We may also collect your phone number and email address. We may collect information about your company and job title. In some cases, we may share this information for the purpose noted above.


Demographic information
. We may collect or receive information like your age and gender. We may also collect your zip code and state. We may also receive information about your estimated income or education to help tailor our services to you. We may also receive information about property ownership. For example, to help us service warranty claims. In some cases, we may share this information for the purpose noted above.


Financial information. 
We may collect certain payment card information and card type. This includes billing address. From customers who buy our products on credit, we may collect certain information like your social security number to run a credit check.


Equipment information
. We collect information from and about your equipment, your usage of that equipment, and your interactions with our services. This may include information about the equipment’s network connection and the equipment’s location. It may include performance and operational data, such as resource consumption and information about equipment errors. We collect information about the equipment itself, including serial numbers from equipment, components installed in relation to the equipment, or any installation, update, or maintenance performed on the equipment. We also may collect data about the environment around the equipment. Examples of this include occupancy and decibel levels, temperature, and air quality. In some cases, we may share this information for the purpose noted above.


Usage information.
 We collect logs and session data when you use our platforms. This may include approximate location information. We collect browser and operating system information. We collect what site you came from or what site you visit when you leave us. We also look at the areas of our site you visit and any actions you make, including information about any product or service preferences. We collect your IP address. We also collect device identifiers. This might include your hardware model. In some cases, we may share this information for the purpose noted above. In some cases, we may share this information for the purpose noted above.


Submitted information. 
We collect any other information you voluntarily provide to us. This may include information you submit as part of a warranty claim or service request, or any feedback you may provide about our products or services.  This includes comments on social media sites. In some cases, we may share this information for the purpose noted above.


Job applicant and professional information. 

If you apply for a job, we collect information about your prior education and work history. This includes information about your skills and qualifications for the position. We may ask about your salary expectations and how you learned of the position. We may ask about your ability to perform the position.

We do not use or disclose sensitive personal information or biometric information, as defined by the laws of California and similar states, for inferring characteristics or for purposes other than those permitted by law. We keep these categories of personal information as long as necessary or relevant for the purposes for which it was collected. We also keep information as required by law.


Business Purposes for Collecting Information

We use the information we collect for a variety of reasons. Those are described below:


We use information to communicate with you.
 We use information to send you updates and to respond to your questions. This includes sending you information about your equipment. We also use information to communicate with you about our policies and terms. If you apply for a job, we use information to process your application.


We use information to provide and improve our services. 
We use information to host and improve our platforms and provide services. This includes selling, servicing, and repairing equipment. It includes administering equipment warranties. We also use this information to update and repair your equipment and resolve technical issues. We use information to make our platforms and services better. This includes research and development. This may also include customizing or personalizing your experience with us. For example, inferences may be made from equipment information to automatically adjust your settings. This may include adjustments to temperature based on your equipment use. We may also use information to recognize our customers or store passwords. We may use information to send you energy usage reports or tips.


We use information for marketing purposes. 
We may use information to let you know about new product developments or services. This may be about our offers or offerings of third parties. We also use information to provide you with newsletters or other content we think you may find interesting. We may do this by phone or email. We may also use your information to engage in interest-based advertising. This includes serving you with content on our platforms or on social media platforms. This may occur after you leave our sites or platforms and may encourage you to return. We may also serve ads that we think are relevant to you based on your browsing habits or online activities.


We use information to protect ourselves and others.
 We use information to protect our company. This includes to identify fraud or secure our systems. We may also use information to protect our website visitors.


If you are in Europe we process your information for different purposes. Our basis for processing your information is typically to perform a contract. Performance of a contract includes responding to your requests or administering a warranty. Where this applies, if you choose not to provide information, we may be unable to perform the contract or respond to your request. We also process information based on consent or for our legitimate purposes.

How We Collect Information

We collect information directly from you. We collect information if you create an account or contact us. This includes when you contact us about a service request, request technical support, or submit a warranty claim. We also collect information from you if sign up for email communications, or otherwise submit it to us. This could be in person, such as at events and product showrooms. It may also be over the phone or online or on a hard copy document.


We collect information passively.
 We collect information about users over time and across different websites and apps. We also work with third parties that collect personal information this way. We may several common tracking tools to collect information. Tracking tools include browser cookies and web beacons. To learn more about cookies visit the FTC’s Online Tracking page. We may work with others to gather information on our platforms and elsewhere. We may do this on our websites and in emails that we send to you. We collect information about users over time when you use our websites. We also collect information through sensors on our equipment.


We collect information about you from others.
 Business associates may provide information about you to us. For example, when dealers or distributors install equipment, they give us information about you to register a warranty. We may also collect information from referrals or industry associations. We may collect information from credit-rating services, or and property records. We may also append data about you from public databases or data analytics vendors. This includes both demographic and geographic data enrichment.


We Combine Information

We combine information we collect from you online with information we receive from you offline. We combine information that we have collected across third party platforms. We combine information across devices, such as equipment, computers and mobile devices. We also combine information you provide with information we obtain from third parties.


We Disclose Information to Others

Below we have explained those entities with whom we might transfer personal information.


We may disclose information within our family of companies. 
We may disclose all categories of information with our parent company Daikin Industries, Ltd. We may also provide this same information to our affiliates and other related companies and subsidiaries. This includes current and future companies.


We disclose information to business associates who help us sell, repair, and install services. 
This may include providing contact and equipment information to dealers and distributors. In some cases, this information and usage information will be provided if you request services from these associates. It also includes service technicians.


We disclose information to vendors who perform services on our behalf.
 We may disclose all categories of information to trusted vendors that provide us with services. For example, we may provide contact, demographic, and usage information to vendors who help us send marketing communications or who help operate our sites. This also includes vendors that help improve our services. Vendors that help us process orders may receive payment information. We may provide job applicant and professional information to service providers who help us evaluate job applicants.


We may share information for cross-contextual behavioral advertising. 
We may share information with third parties in order to provide cross-contextual behavioral advertising. In the Notice at Collection (above) we outlined which categories of information are shared for cross-contextual behavioral advertising.


We disclose information if we think we have to in order to comply with the law or to protect ourselves. 
We disclose all categories of information we collect about you to respond to a court order or subpoena. This includes responding to a government agen.cy or investigatory body request. It also includes investigations of potential fraud. When we investigate or enforce potential violations of our terms or policies we may disclose all categories of information.


We disclose information to any successor to all or part of our business. 
If all or part of our business was sold, we may transfer all categories of information as part of that transaction. All categories may be disclosed in merger or acquisition. This is also the case if there is a financing or bankruptcy.


We disclose information as permitted by law and for other reasons we may describe to you.


Additional information for
California, Colorado, Connecticut, Florida, Oregon, Nevada, Texas, Utah, or Virginia residents or residents of similar jurisdictions. The laws of California, Colorado, Connecticut, Florida, Oregon, Texas, Utah, or Virginia and similar jurisdictions require that we tell you if we sell personal information with a third party for monetary or other valuable consideration. While we do not monetize personal information, under the interpretations of certain state laws, certain uses of personal information described herein could be considered a “sale.” We do not sell personal information of minors under the age of 16 for monetary or other valuable consideration.


Our Platforms Are Based in the United States

The sites and platforms where this policy appears is intended for people who are in the United States and Canada. If you live outside of the US, you understand and agree that we may transfer your information to the US and that it will be processed under and subject to US laws. It will also be subject to appropriate safeguards under US law. Those safeguards may include standard data protection clauses approved by the European Commission and available on their website at europea.lex. 

US laws may not afford the same level of protection as those in your country. To the extent required, we may provide you with additional rights if you are based in the EU or UK. Those may include rights to access, deletion, and correction. They may also include the following:

  1. The right to a “portable” copy of your information;
  2. The right to ask us to restrict how we process your information;
  3. The right to restrict profiling activities;
  4. The ability to object to having your information used for other purposes; and
  5. The right to direct complaints about our privacy practices to your local Data Protection Authority.


How To Exercise Certain Choices


You can opt out of receiving our marketing emails.
 To stop receiving our promotional emails, follow the “unsubscribe” instructions in any promotional message you get from us. If you live in the EU or UK, you may have additional rights to opt out of direct marketing. Even if you opt out of getting marketing messages, we will still send you transactional messages. This includes responses to your questions or information about a warranty.


You can control cookies and tracking tools.
 Your browser may give you the ability to control cookies or other tracking tools. How you do so depends on the type of tool. Certain browsers can be set to reject browser cookies. If you block cookies, certain features on our sites may not work. If you block or reject cookies, not all of the tracking described here will stop.  


Cross-contextual behavioral advertising. 
To opt out of cross-contextual behavioral advertising, read our Notice of the Right to Opt-Out of Sharing, below. Additionally, the Self-Regulatory Program for Online Behavioral Advertising provides consumers with the ability to manage certain choices online here and provides a tool for managing mobile choices here.


Our Do Not Track Policy: 
Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. We do not currently respond to those signals.

  4. Correction: asking us to fix your information; and
  5. Non-retaliation: not to be discriminated against for exercising a privacy right.


How it works. 
When you submit your request, we use information you provide to verify your request. We do this by matching the information you provide with information we already have about you. In some situations we may not be able to process your request. This may include if a legal exception applies. If you disagree with our decision you can contact us as described at the end of this policy.


Notice of Right to Opt-out of Sharing for Cross-Contextual Behavioral Advertising
: You can opt out of the sharing of your personal information for cross-contextual behavioral advertising by visiting here and turning the button to “inactive” for cross-contextual behavioral advertising cookies. You can also visit our online form. Some browsers or browser extensions also allow you to tell websites not to share your information for cross-contextual behavioral advertising through a “global privacy control” signal. We will respond to this kind of signal in a frictionless manner. If you configure this setting on your browser, certain features on our site may not work and you will receive less targeted advertising. To learn how to configure this setting, view here.


You may email us at Privacy@DaikinComfort.com to opt out of the future sale of your information to a third party so that they may license or sell information.


Third party agents
: If you are submitting a request on behalf of a resident of California, Colorado, Connecticut, Florida, Oregon, Texas, Utah, Virginia, or similar jurisdictions, we may ask for additional information to verify your identity. This may include providing proof that you are registered with the Secretary of State to act on someone’s behalf or proof of a power of attorney.


We Use Standard Security Measures

The Internet is not 100% secure. We cannot promise that your use of our sites or platforms will be completely safe. We encourage you to use caution when using the Internet. This includes not sharing your passwords.


Third Party Sites and Links

If you click on a link to a third party platform, you will be taken to platforms we do not control. This includes our social media pages. These third parties’ privacy policies may be different than ours, and our privacy policy does not apply to their actions. We are not responsible for these third party practices and encourage you to read their policies carefully.


These Sites are Not Intended For Children

Our sites are meant for adults. We do not knowingly collect personally identifiable information online from children under 13. If you are a parent or legal guardian and think your child under 13 has given us information, you can email us. You can also write to us at the address listed at the end of this policy.
